GM Vault Terms of Use.

By accessing or using GM Vault, you agree to these Terms of Use and all referenced policies, including the Seller Agreement, Bidder Agreement, Auction Rules, Vehicle Disclosure Statement, and Privacy Policy.

• You must be at least 18 years old.
• You must have legal authority to enter into binding contracts.
• You must provide accurate, current account information.

GM Vault may, at its sole discretion, verify identity, suspend accounts, permanently ban users, or reject listings for any reason or no reason.

GM Vault does not own listed vehicles, does not inspect vehicles, does not guarantee vehicle condition, does not verify mileage, and does not guarantee title status. Users assume all risks associated with researching, bidding on, buying, and selling vehicles.

All vehicles listed on GM Vault are presented and sold strictly on an "AS-IS, WHERE-IS" basis, with all faults and without any warranty of any kind, whether express or implied, including but not limited to any implied warranty of merchantability or fitness for a particular purpose. Listings are prepared by sellers to the best of their knowledge, and GM Vault promotes each vehicle based on the information and media provided by the seller. Neither GM Vault nor any seller represents that a listing is free from errors, omissions, or undiscovered conditions.

Bidders are strongly encouraged, and have the unrestricted right, to conduct their own pre-purchase due diligence prior to bidding. This includes, without limitation, the right to travel to the vehicle's location to inspect it in person, to arrange a third-party pre-purchase inspection, and to make their own arrangements for transport, including driving the vehicle home or dispatching a trailer or carrier of their choice. Placing a bid constitutes the bidder's acknowledgment that they have had a full and fair opportunity to inspect the vehicle and that they accept the vehicle in its existing condition as of the close of auction.

Buyers pay a 5% buyer's premium calculated on the final sale price, charged to the bidder's payment method on file. The full sale price is paid directly to the seller. Sellers pay listing fees as published on the site. Fees are non-refundable except as expressly stated.

To the maximum extent permitted by law, GM Vault is not liable for vehicle defects, fraud by users, failed transactions, lost profits, shipping issues, or title disputes. GM Vault's aggregate liability shall not exceed the fees paid by you to GM Vault in the twelve months preceding the claim.

Any dispute arising out of or relating to GM Vault shall be resolved through final, binding arbitration administered in California under the rules of the American Arbitration Association. You waive any right to participate in a class action.

GM Vault may modify these Terms at any time. Continued use of the platform after changes constitutes acceptance.

GM Vault offers an optional SMS reminder service that sends automated text messages to registered users approximately 30 minutes before an auction they have specifically requested a reminder for begins or ends. Reminder messages may be sent using an automatic telephone dialing system (autodialer). Users only receive reminder messages for vehicles they have individually opted in to follow — GM Vault does not send marketing, promotional, or bulk SMS through this system.

Message frequency varies based on the number of auctions a user requests reminders for. Messages will be sent via an autodialer and the agreement to receive the autodialed text messages isn't a condition of any purchase. Consent to receive autodialed SMS reminders is not a condition of purchase or of using the GM Vault marketplace. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Message and data rates may apply based on the user's mobile carrier plan. Users may reply STOP to any reminder message to opt out of all future SMS from GM Vault, or reply HELP for assistance. Users may also cancel any individual reminder from the corresponding auction listing at any time.
